Our members have over a hundred years of experience in analyzing debtor/creditor relationships. Members of the firm advise financial institutions, business entities and individuals interested in preserving their rights as lenders, suppliers, or as other creditors, and when necessary in enforcing their remedies in bankruptcy, under the Uniform Commercial Code, by foreclosures, through litigation, levies, attachments, garnishments and other types of recovery. The firm has extensive experience in managing and protecting creditors’ rights in bankruptcy, workouts, out-of-Court reorganizations, receiverships and other settlements of payment disputes.
As Trustees: Members of the firm have in aggregate more than fifty years of experience as Chapter 7 and Chapter 11 trustees, appointed by the Courts, by the Office of the United States Trustee, and by Creditors committees, and have served in literally thousands of cases.
As Trustee Representatives: Ragsdale, Beals, Seigler, Patterson & Gray, LLP regularly represents trustees in Chapter 7 and Chapter 11 cases, providing the full range of services required by the trustee, advising with respect to the powers and duties of the trustee, and overseeing the other reports and services required by the United States Trustee. The firm effectively prosecutes claims for recoveries of preferential transfers, fraudulent conveyances and other avoidance actions, assists in negotiated or other dispositions of estate assets, where appropriate objects to claims, and assures proper adherence to and documentation of all bankruptcy rules and procedures.
As Debtor Representatives: In the representation of corporate and individual Chapter 11 debtors and in non-routine Chapter 7 cases our attorneys oversee the creation of comprehensive schedules, negotiate with holders of secured claims, oversee compliance with all requirements of the United States Trustee, develop, with the principals, disclosure statements and plans, and represent the debtor in all of the aspects of the case.
